Disciplinary and Penal Case Committee
The Disciplinary and Penal Case Committee ensures protection of the public interest by establishing and maintaining a framework for addressing matters referred to The Nursing Council for investigation and disciplinary action in accordance with The Nurses and Midwives Complaints and Disciplinary Proceedings Regulations.
The roles and responsibilities of this committee include:
- Investigating complaints filed regarding the conduct or action(s) of a nurse or midwife.
- Providing written notice to the nurse or midwife subject to a complaint within thirty days.
- Carefully considering written submissions and reviewing all relevant records and documents.
- Recommending actions to the Council such as:
- No further action.
- Referral to the disciplinary committee if allegations are found to be factual.
- Requiring the nurse or midwife to appear before the investigation committee for caution.
- Any other action deemed appropriate under the Act.
The Committee has the authority to:
- Direct the Registrar to revoke a member’s certificate of registration.
- Suspend a member’s certificate for a specified period.
- Lift the suspension upon compliance with specified conditions.
- Impose terms, conditions, or limitations on a certificate for a defined or indefinite period.
- Require a member to appear before the Discipline Committee to be reprimanded.
- Impose a monetary fine.
The Council also has a Nursing Appeal Tribunal responsible for investigating grievances raised by nurses or midwives. This tribunal consists of a Chairman and two members appointed by the Minister.
